5. Bambancin Addini. Shi ma yana hana aure tsakanin namiji da mace. Mace ba zata auri wanda ba musulimi ba. Amma a mazhabar sunna, namiji zai iya auren mace ma’abociyar littafi wacce aka fi sani da ahlul kitabi ko bakitabiya wato kirista, bayahudiya ko wani adddini da yake asalin saukarsa daga Allah ne. Amma Shi’a sun ce namiji ba zai qulla dauwamammen aure da wacce ba musulma ba, sai dai auren wucin gadi (mutu'a). (Sharhul Lum'a 5, 156 Riyad, 11, 105 – 06). Idan xaya daga ma’auratan ya bar musulinci to ba makawa auren ya rushe.
6.  Mafi Yawan Adadin Mata. Namiji ba zai auri mata sama da huxu a lokaci xaya ba. Idan da namiji zai saki xaya daga cikin matansa, ba zai sake wani auren ba   har sai matar ta gama iddar ta, sai dai idan sakin ba na kome ba ne.
 7. Saki. Idan namiji ya saki matarsa sakin da ba kome to ta haramta gare shi har abada, har sai idan ta auri wani mijin daban kuma suka rabu. Da zarar sun rabu da mijin na biyu kuma ta gama iddarta, to tana iya sake auran mijinta na farko. Kuma lalle ya zama mijin na biyu ya take ta kafin su rabu ta sake aurer mijin na farkon.(Fiqhu 4, 77 – 84; Riyad 11, 181 Sharhul Lum'a 5i, 46).
8. Rantsuwar Qin Ubantakar Xa Ko ‘Ya (Li’ani) 
Aure wanda ya yi rantsuwar li’ani da mace ya haramta ya kuma aure ta har abada.

C- Waliyyin Aure
Waliyyi na aure kan kasance uba, kaka (Hanafi'iyya shafi’iyya, Shi’a), haka ma wanda  uba ya yi wa wasicin daura auren, sannan mai gari ko shugaban al’umma, idan babu waxanda aka ambata a baya a wajen Hambalawa, da uban gidan bawa a wajen Malikawa. Mace ba ta walicci in banda a mazhabar Hanafi. Su Hanafawa cewa suka yi: idan babu xan'uwa na jini sosai  to ‘yar uwa mace ta jini kan yi waliccin aure.(Fiqhu, 4, 27).
Mazhabobin Malikiyya da Shafi’iyya sun ce samun waliyyi daga vangaren yarinya na daga shika-shikan aure, amma mazhabar Hambaliyya sun ce: wanna sharaxi ne, wato auren na tabbata ko da waliyyyi bai halarci xaurin auren ba, matuqar waliyyin ya bada umarni.(Ibid, 46 – 47). A taqaice dai mazhabobin nan uku sun tafi a kan cewa mace ba ta da damar qulla aure ba tare da sa hannun waliyyinta ba. (Muhimman abubuwan da suka yi bayani sun zo ne cikin wasu hadisai guda biyu ingattattu: Idan aka samu wata daga cikin 'ya'yanku mata, suka daura aure ba tare da izini ko yardar iyayenta ko waliyanta ba, to wannan auren batacce ne, (Abu Dawud, kitabun-nikah 19: addarimi, kitabun-nikah 11). "Mace ba za ta bada auren mace 'yar'uwarta ba, kuma mace ba zai yi wu ta wakilci mace domin aurar da kanta ba" (Ibn Majah, Kitabun-nikah 15, Malik, Kitabun-Nikah 5). A mazhabobin Shi’a da hanafiyya halartar waliyyi yana zama lalle ne yayin aurar da qaramar yarinya, wato wacce ba ta balaga ba, ko yarinya me tavin hankali ko babbar mace. Duk mazhabobin sun tafi a kan cewa balagaggiyar mace kan auri duk wanda ta zava, kuma halaccin qulla auren ba ya ta’allaqa da halartar waliyyi. (Fiqhu, 4, 46 – 47, Sharhul Lam'a 5, 112 Mohd dan Alhassan Alhurr Al amuli (d. 1104 – 1693), Wasailusshi'a Tehran, 1385/1965 – 66, x4, 220 – 221, Hadisi 1-3). Sai dai mazhabar Hanafiyya sun qara da cewa, tun da daidaito na yanayin wayewar rayuwa tsakanin ma’aurata na daga sharaxin qulla aure, waliyyi na iya vata auren da mace ta qulla da kanta tare da mijin da ba tsaranta ba (kufu’inta).(Fiqhu, 4, 46).
Malikiyya, Hambaliyya da Shafi’iyya sun ce waliyyyi zai iya aurar da budurwa ba tare da yardar ta ba, yarinya ce ko kuma babba. Amma babbar mace ko yarinya matuqar ta tava aure ba za a aurar da ita ba ba tare da yardar ta ba (Ibid, 51 – 52). Hanafiyya da Shi’a sun  tafi a kan cewa, kawai yarinya qarama ce za a iya aurar da ita ba tare da amincewarta ba. (Ibid, Sharhul Lum'a 5, 116). Shafi’iyya sun qara da cewa idan yarinya qarama ta tava aure to ba za a qara aurar da ita ba har sai ta qara girma.(Fiqhu, 4, 51 – 52).
Suma yara maza dokokin walicci na hawa kansu haka ma wawaye masu qarancin hankali.(Ibid, 51).

D. Shaidu. 
Shafi’iyya, Hambaliyya da Hanafiyya sun tafi a kan cewa shaidu biyu a wajen aure na daga shika-shikan aure, dan haka rashin halartarsu na vata qulla aure. (Ibid, 25). Maliki ya ce halartar shaidu biyu wajibi ne, kafin yin dukhuli  ko lokacin yin dukhulin, (dukhuli shi ne kevewar ma'aurata a xaki), kuma ba wajibi ba ne su halarci qulla auren, duk da cewa mustahabbi ne su halarta.(Ibid, 51). Shi’a kuwa sun tafi a kan cewa halartar shaida ko shaidu ba sharaxin aure ba ne, dan haka namiji da mace za su iya qulla aure a voye idan sun so.(Sharhul Lum'a 5, 112 Riyad, 11, 70).
